In principle, there will be no contract that will be concluded with us. The tenant will neither be charge with commission nor with other payments. The inquiries and the conclusion of a lease are free of commission. The contract will be concluded exclusively between the landlord of the offered apartment and the potential tenant on this website.
We have no influence on the accuracy of the advertisements created by the landlord. The tenant has no legal right towards us.
General:
The landlord of an apartment accepts the terms and conditions by accepting the subscription offer. The landlord concludes all contracts independently with the tenant. Any form of support does not take place. We recommend you to refer to the city of Munich’s Housing Alienation Ordinance (“Wohnraumzweckentfremdungsverordnung”) for further information about the concerned regulations. Every landlord has to be informed about the city’s housing rules and regulations before subscribing in our service. We do not offer any legal advice regarding this matter.
1. Subject of Contract and Commissioning
The landlord should book a subscription for each apartment that he offers in an advertisement. The order by the landlord must be in writing. If the landlord rents or offers a potential tenant an apartment which has not been booked for subscription, the landlord violates the terms of our contract agreement, thus, will result to the termination of all the landlord’s subscriptions without prior notice. Already paid subscriptions are not subjected to refund, neither in partial nor full amount. The landlord has to initiate the assessment of the tenant (self-assessment) independently. We don’t offer support for the assessment.
2. Obligations of the Landlord
The landlord assures and confirms that all the given information are complete and truthful by accepting the subscription. The landlord undertakes to offer the potential tenant only the apartments for which the landlord has a subscription. The termination of all subscriptions without prior notice follows, in case, the landlord violates the regulation. A refund of subscription fees is generally excluded.
3. Termination of Subscription
The subscription cannot be terminated by any contracting party during the term of the subscription, with the exception of termination without notice in accordance with point 1 of these Terms & Conditions. If no party terminates the subscription with a notice period of 4 weeks until the end of the subscription, the subscription will be extended in the same term. Notice of termination must be given in writing.
4. Change of the terms and conditions
We have the right at our sole and arbitrary discretion to make changes to the General Terms and Conditions at any time and without prior agreement. The new terms and conditions will be published on the homepage, the landlord will be informed by e-mail. If the landlord still uses the subscription and did not object to the changes of General Terms and Conditions within 14 days of notification, this will be considered as consent. It does not matter if the new terms and conditions have been read by the landlord. If the landlord contradicts the new terms and conditions within 14 days of notification, the subscription will be terminated and the landlord will receive a refund of the subscription fee by prorate basis.
5. Subscription Plans
Plan 1: six-month subscription for € 300, —
Plan 2: twelve-month subscription for € 480, —
The landlord has to comply with the system specifications of this website when placing an ad of the apartment(s). Own systematic changes are not possible.
6. Presentation, Description and Images
The landlord authorizes us to provide his descriptions and images (photo / video) of the apartment(s) offered for publication on this website.
7. Privacy
The landlord must agree that we are allowed to disclose his personal contact information to a potential tenant. If he fails to agree with this condition, any subscription will not be possible according to the paragraph 5 of the General Terms and Conditions.
8. Jurisdiction and Applicable Law
Munich is a place of jurisdiction. The legal conditions of the Civil Code of the Federal Republic of Germany are strictly observed and followed.
